Warranty and Australian Consumer Law

This page explains the voluntary warranty and the Australian Consumer Law guarantees that apply to April's Form orders in Australia.

Policy summary

  • A 12-month voluntary warranty applies to manufacturing and structural defects, subject to exclusions and ACL rights.
  • Natural variation, normal patina, misuse, unsuitable cleaning and unauthorised installation are not treated as warranty defects unless law requires otherwise.
  • Accepted remedies may include repair, replacement, re-supply, compensation or another remedy required by law.

Mandatory ACL statement

  • This policy uses the ACL mandatory wording for goods and services supplied after 9 June 2019.
  • Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.
  • You are also entitled to choose a refund or replacement for major failures with goods.
  • If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.
  • You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Voluntary warranty

  • In addition to your ACL rights, we provide a voluntary warranty against manufacturing defects and structural defects for 12 months from the date the goods are delivered to you.
  • The benefits given by this voluntary warranty are in addition to any rights and remedies you may have under the ACL or any other law.
  • This warranty is provided to the original purchaser unless we agree otherwise in writing or the law requires otherwise.

What the warranty covers

  • Subject to the exclusions below and your ACL rights, this warranty covers:
  • manufacturing defects in the finished goods;
  • structural defects arising from normal intended use;
  • defects that cause the goods to materially depart from the approved written specification; and
  • defects in workmanship that appear during the warranty period and are not caused by misuse, site conditions, third-party work, or improper care.

What we will do for a valid warranty claim

  • If we accept a warranty claim, we will provide an appropriate remedy having regard to the issue, the piece, available materials, feasibility, and the ACL. Where the ACL gives you a choice of remedy, this warranty does not remove that choice.
  • The remedy may include repair, replacement, re-supply of a service, compensation, or another remedy required by law.
  • Repairs and replacements involving natural stone may not be identical in colour, veining, pattern, or movement to the original piece because stone is naturally variable and matching material may not be available.
  • We will carry out accepted warranty remedies within a reasonable time after assessment and after practical arrangements are confirmed.

What you must do to claim

  • Contact us within a reasonable time after you become aware of the issue.
  • Email hello@aprilsform.com.au with:
  • your name, contact details, and order number;
  • delivery date;
  • a description of the issue and when it first appeared;
  • photos and, where useful, video;
  • care and cleaning history;
  • installation details if relevant;
  • delivery documents or packaging photos if the issue may relate to transit; and
  • the outcome you are seeking.
  • You must give us a reasonable opportunity to inspect the goods in person or remotely before repair, return, disposal, alteration, or third-party work is carried out, unless urgent action is needed for safety.

Claim expenses

  • If your warranty or ACL claim is accepted, we will bear reasonable costs that the law requires us to bear and that are necessary to provide the remedy.
  • If you incur expenses for an accepted claim, contact us first where practical so we can confirm the required steps and reasonable costs.
  • If a claim is not valid, or the issue was caused by misuse, improper care, unauthorised installation, third-party work, site conditions, or a change of mind, you may be responsible for reasonable inspection, transport, repair, redelivery, or storage costs where permitted by law.
  • Nothing in this section limits expenses or remedies that must be provided under the ACL.

What the warranty does not cover

  • Subject to your ACL rights, this voluntary warranty does not cover:
  • natural variation in stone, including colour, veining, fissures, pores, filled areas, movement, texture, and tone;
  • minor differences between samples, photos, videos, renders, screens, lighting conditions, and the finished piece;
  • normal wear, patina, ageing, sealant wear, small surface marks, or ordinary changes from use;
  • stains, etching, dulling, water marks, or heat marks caused by spills, acidic substances, abrasive products, unsuitable cleaners, standing water, cosmetics, alcohol, oil, heat, or failure to wipe or dry the surface;
  • damage from misuse, accident, dropping, dragging, impact, overloading, sitting or standing on the goods, unsupported placement, or unsuitable site conditions;
  • damage caused by outdoor, coastal, commercial, bathroom, wet-area, or high-use exposure where that use was not approved in writing for the selected stone and finish;
  • damage caused by failure to reseal or maintain the goods as recommended;
  • damage caused by third-party delivery, storage, installation, alteration, repair, plumbing, waterproofing, fixing, building work, or movement not arranged by us;
  • damage caused by inaccurate specifications, drawings, access details, or site information supplied by you or your representative;
  • defects in materials, fixtures, or trades not supplied by us; or
  • any issue that was disclosed to you before purchase and accepted as part of the approved specification.

Manufacturer or supplier review

  • We may consult the manufacturer, fabricator, delivery partner, installer, or other expert to assess a claim.
  • We will not require you to deal directly with a manufacturer or supplier where we are legally responsible for providing a remedy.
  • Any separate manufacturer warranty is in addition to, and does not replace, this warranty or your ACL rights.

Australian Consumer Law

  • This voluntary warranty does not limit, exclude, or replace any guarantee, right, or remedy that cannot be excluded under the ACL.
  • ACL rights may apply after the voluntary warranty period, depending on the goods, price, representations made, and what a reasonable consumer would expect.
  • Any warranty exclusion must be read subject to the ACL.
