Terms of sale

Terms of sale define custom quotes, deposits, production approvals, changes, cancellations, natural variation, delivery, inspection, and payment timing.

Policy summary

  • Each piece is made to order after written quote approval and cleared deposit.
  • Quotes depend on dimensions, stone, finish, freight, access, payment stages and approval details.
  • Natural stone variation, delivery risk and Australian Consumer Law rights remain visible before deposit.

Quotes

  • Quotes are valid for 30 days from the date issued unless the quote states a different validity period.
  • Quotes are based on the information available at the time, including piece type, dimensions, stone selection, finish, edge profile, quantity, delivery suburb, access information, installation assumptions, project timing, and any drawings or reference material you provide.
  • A quote may separate piece price, freight, delivery, installation, storage, samples, payment surcharges, GST, customs, duties, taxes, and other charges where they are not yet known or not included.
  • Before you are asked to pay for an order, we will confirm the amount payable at that stage and any known mandatory charges. If a charge cannot reasonably be calculated yet, we will explain the assumption or estimate being used.
  • Consumer-facing prices are shown in Australian dollars and inclusive of GST where GST applies, unless the communication is clearly directed to business customers only. Trade or wholesale prices may be shown exclusive of GST where clearly marked.
  • We will not treat a quote as accepted until the order steps in section 2 are complete.

Orders and acceptance

  • An order is accepted, and production is scheduled, only when we receive your signed quote or written approval and cleared deposit.
  • If there is any inconsistency between your signed quote or order confirmation and these general terms, the signed quote or order confirmation applies to the extent of the inconsistency, unless the law requires otherwise.
  • Each piece is made to order. Before approving the order, you are responsible for checking the written specifications, dimensions, stone, finish, edge profile, base design, tolerances, quantity, delivery address, access details, and any site or installation assumptions.
  • If you are ordering through a designer, architect, builder, or trade professional, that person must have authority to approve specifications and order documents on your behalf.
  • We may decline or pause an order if required information is missing, if the requested piece is not feasible, if a supplier cannot confirm availability, or if payment has not cleared.

Made-to-order stone

  • Goods are produced specifically for the approved order and are not held as standard stock.
  • Natural stone varies in colour, veining, pattern, mineral movement, pores, fissures, filled areas, and tone. These characteristics are inherent to natural stone and are not defects where they are consistent with the approved description, sample, disclosure, or normal character of the stone.
  • Samples, renders, photos, and quality-control images are guides only. They help set expectations, but they cannot guarantee an identical match to the final slab, block, or finished piece.
  • Stated dimensions, weights, colours, and finishes may be subject to reasonable manufacturing and natural-material tolerances. Any critical tolerance must be identified before quote approval and confirmed in writing.

Payment schedule

  • Unless agreed otherwise in writing, payment is staged as follows:
  • 50% deposit on order approval;
  • 40% after quality-control photos or video are provided for review and before shipment or release from the manufacturer; and
  • 10% before delivery is booked or released to you.
  • Production does not begin until the deposit clears. Shipment or release does not occur until the pre-shipment payment clears. Delivery does not need to be booked until the final balance and any agreed delivery, storage, or handling charges have cleared.
  • If payment is late, we may pause production, shipment, delivery booking, or release of the goods. Delays caused by late payment may affect lead times and delivery windows.
  • You are responsible for any bank fees, international transfer fees, card surcharges, or payment charges disclosed before payment, to the extent permitted by law. Any card surcharge will not exceed the amount it costs us to accept that payment type.
  • We issue a tax invoice that meets Australian Taxation Office requirements for orders where GST applies.

Deposits, changes, and cancellation

  • The deposit covers design administration, supplier coordination, stone or material commitment, production scheduling, and other costs incurred to secure a made-to-order piece.
  • Before production, stone commitment, or supplier commitment has begun, you may request cancellation. We may deduct reasonable costs already incurred and refund any balance, unless the quote states a more favourable cancellation right.
  • Once production, stone commitment, or supplier commitment has begun, change-of-mind cancellation may not be available, and the deposit may be retained to the extent it reflects reasonable costs and losses we have incurred or committed to. This does not affect your rights under the ACL.
  • Changes requested after approval may not be possible. If a change is possible, it may alter price, lead time, freight, warranty, feasibility, or delivery assumptions. We will confirm any accepted change in writing before proceeding.
  • If we cannot supply the ordered goods or services within a reasonable time, or at all, for reasons within our responsibility, we will discuss the available solution with you, which may include a refund, revised timing, substitute specification, or other remedy required by law.

Quality-control review

  • Where practical, we may provide quality-control photos or video before shipment. You must review them promptly and raise any visible concern before approval.
  • Your approval of quality-control material confirms that the visible features shown are acceptable for shipment, but it does not remove any non-excludable rights you have under the ACL.
  • Minor differences between photos, screens, lighting, samples, and the final installed context are expected with natural materials.

Lead times and delays

  • Lead times are estimates, not guarantees, unless we expressly agree a guaranteed date in writing.
  • Indicative production timing, freight, customs clearance, delivery coordination, and any site or access scheduling should be confirmed in the written quote or order confirmation.
  • Lead times may be affected by stone availability, manufacturing capacity, quality-control issues, customs, freight, port congestion, weather, industrial action, site access, payment delays, or events beyond reasonable control.
  • We will give updates about material delays when we become aware of them. If a delay becomes substantial, we will discuss the practical options available for the order. Nothing in this clause limits any remedy available under the ACL.

Delivery, installation, title, and risk

  • Delivery and installation are governed by our Delivery and Installation policy and the delivery scope stated in your quote.
  • Title to the goods passes to you only when we receive full cleared payment for the order and any agreed delivery, storage, or handling charges.
  • Risk in the goods passes to you on delivery in accordance with the Delivery and Installation policy, unless the law requires otherwise.
  • If delivery is delayed because you are not ready to receive the goods, access information is inaccurate, payment has not cleared, or no authorised person is present, additional redelivery, handling, or storage charges may apply where reasonable and disclosed.

Your information and site responsibilities

  • You must provide accurate and complete information needed to quote, produce, and deliver the goods, including dimensions, drawings, stone preferences, delivery address, access constraints, building rules, lift dimensions, stairs, parking, loading areas, and project timing.
  • For built-in, bathroom, wet-area, outdoor, commercial, wall-fixed, floor-fixed, or structurally supported pieces, you are responsible for obtaining suitable professional advice from your builder, installer, engineer, plumber, waterproofer, or other relevant trade unless we expressly agree otherwise in writing.
  • We are not responsible for loss or damage caused by inaccurate information, unsuitable site conditions, unauthorised installation, misuse, or failure to follow care guidance, except to the extent required by the ACL or other law.

Australian Consumer Law

  • Our goods and services come with guarantees that cannot be excluded under the ACL.
  • Nothing in these Terms of Sale excludes, restricts, or modifies any guarantee, right, or remedy you have under the ACL or any other law that cannot be excluded, restricted, or modified.
  • Terms dealing with deposits, cancellation, delivery timeframes, warranty, returns, inspection windows, exclusions, liability, or claim evidence must be read subject to your ACL rights.

Limitation of liability

  • Where the law permits us to limit our liability for a failure to comply with a consumer guarantee, and the goods or services are not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited (at our option) to replacing or repairing the goods, resupplying the services, or paying the cost of doing so.
  • To the extent permitted by law, we are not liable for indirect, special, or consequential loss, and our total liability for any claim connected with an order is limited to the price paid for the affected goods.
  • Nothing in this section limits or excludes any right or remedy that cannot be limited or excluded under the ACL. For goods or services ordinarily acquired for personal, domestic, or household use, these limitations do not apply to the extent the ACL prohibits them.

Country of origin and imported goods

  • Our pieces are designed for April's Form and manufactured overseas using natural stone sourced internationally, then imported into Australia. We do not represent the goods as Australian made.
  • Where we describe a stone's origin, type, or finish, we do so in good faith based on supplier information. Natural stone is a variable material, and minor differences from any description are inherent to the product.

Questions, problems, and complaints

  • If you have a question, complaint, delivery issue, piece concern, or warranty concern, contact us promptly with your order number and supporting information.
  • We will review the issue against the order documents, these policies, and applicable law, and will tell you what further information or next step is required.

Privacy

  • We handle personal information in accordance with our Privacy Policy. Order, delivery, trade, and warranty information may be shared with suppliers, manufacturers, freight providers, installers, payment providers, professional advisers, and other service providers where reasonably necessary to handle your enquiry or order.

Governing Law

  • These terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
